These Terms and Conditions ("Terms") govern use of the RoommatesPlus / RoommatesSwipe application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and Account
You must be at least 18 years old to use the Service.
You are responsible for your account credentials and all activity under your account. You must provide accurate information and keep it updated.
2. What the Service Does
The Service helps users create housing profiles, view listings, express interest in listings, collaborate on applications, and chat with other users (for example, seekers and landlords/managers).
3. Data We Collect and Store
We collect and store data needed to operate the Service, including:
- Authentication and security data (Supabase Auth), including account identifier, email, phone, session/authentication metadata, and security logs/tokens.
- Profile and personal details, including name, email, phone, profile image URL, bio/description, occupation, age, location, gender, and selected social handles.
- Preference data, including rent range, target area, unit/contract preferences, move-in preferences, and lifestyle preferences.
- Listing and property data, including building and unit details, descriptions, amenities/tags, pricing attributes, availability fields, and image paths.
- Interaction and application data, including saved/rejected units, swipes/decisions, application records, application member links, chats, and messages.
- File storage metadata, including storage bucket/object metadata and stored file paths for uploaded images.
We store this data in Supabase-managed PostgreSQL and object storage infrastructure.
4. How We Use Data
We use data to:
- Provide core app functionality (accounts, profiles, listings, matching/swiping, applications, messaging).
- Maintain security, prevent abuse/fraud, and enforce these Terms.
- Operate, troubleshoot, and improve the Service.
- Comply with legal obligations and respond to lawful requests.
We do not sell or share personal data with third-party advertisers for cross-context behavioral advertising.
5. Legal Bases and International Privacy Frameworks
Depending on your location, we rely on legal bases such as contract performance, legitimate interests, consent (where required), and legal obligation.
We aim to operate in a manner compatible with major privacy frameworks, including (as applicable) PIPEDA (Canada), GDPR/UK GDPR, and U.S. state privacy laws (such as CCPA/CPRA concepts), but local rights and obligations may vary by jurisdiction.
6. Cross-Border Processing
Your data may be processed in countries other than your own. Where required, we use reasonable safeguards for international transfers (for example, contractual and organizational controls) consistent with applicable law.
7. User Privacy Rights
Subject to local law, you may request access, correction, deletion, portability, or restriction/objection regarding your personal data by contacting service@roommatesplus.ca.
Where local law grants additional rights, those rights apply. We may need to verify identity before acting on requests.
8. Data Retention and Deletion
We retain data for as long as reasonably necessary for service operation, legal compliance, dispute resolution, and security.
If you request deletion, we will perform deletion on a best-effort basis and within a commercially reasonable timeframe, taking into account backups, technical constraints, and legal obligations.
9. Security Measures
We use reasonable administrative, technical, and organizational measures to protect data, including access controls and database security features (such as row-level access controls where configured). No system can be guaranteed 100% secure.
10. Acceptable Use
You must not:
- Violate laws or third-party rights.
- Upload fraudulent, defamatory, infringing, or abusive content.
- Attempt unauthorized access, scraping, reverse engineering, or service disruption.
- Impersonate others or misrepresent listing/application information.
We may suspend or terminate accounts for violations.
11. User Content and License
You retain rights in content you submit, but grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content solely to operate and improve the Service.
You represent that you have rights to submit the content and that it does not violate law or third-party rights.
12. Intellectual Property and Non-Derivative Use
All rights, title, and interest in and to the Service—including but not limited to its software, design, user interface, features, functionality, databases, text, graphics, logos, and underlying technology—are and remain the exclusive property of the service provider and its partners.
You must not, and must not permit others to:
- Copy, reproduce, distribute, or publicly display any part of the Service except as expressly permitted.
- Modify, adapt, translate, or create derivative works based on the Service or any part of it.
- Reverse engineer, decompile, disassemble, or attempt to extract source code or underlying ideas, algorithms, or structure of the Service.
- Use the Service or its outputs to develop, train, or improve any competing product or service.
- Replicate or build a substantially similar product, service, or feature set based on the Service.
Any unauthorized use of the Service or its intellectual property is strictly prohibited and may result in termination of access and legal action.
13. Third-Party Services
The Service relies on third-party infrastructure/providers (for example, Supabase and cloud infrastructure). Their outages, changes, or limitations may affect the Service.
14. Disclaimers
The Service is provided on an "as is" and "as available" basis, to the maximum extent permitted by law. We do not guarantee uninterrupted, error-free, or fully secure operation, nor guaranteed suitability of listings, users, matches, or outcomes.
15. Limitation of Liability
To the maximum extent permitted by law, the service provider and its partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunity, arising from or related to the Service.
To the maximum extent permitted by law, total aggregate liability for claims related to the Service will not exceed the greater of the amounts you paid to us for the Service in the 12 months before the event giving rise to liability.
Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnity
You agree to defend, indemnify, and hold harmless the service provider and its partners from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or law.
17. Suspension and Termination
We may suspend or terminate access for violations, risk, legal reasons, or service changes. You may stop using the Service at any time.
18. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when posted (or as otherwise required by law). Continued use after updates constitutes acceptance.
19. Governing Law and Disputes
These Terms are governed by the laws of Nova Scotia, Canada, excluding conflict-of-law rules.
You and we agree that courts located in Nova Scotia, Canada have exclusive jurisdiction over disputes arising from or related to these Terms or the Service, subject to mandatory consumer-law rights in your place of residence where such rights cannot be waived.
