These Terms and Conditions ("Terms") govern use of the roommates+ / RoommatesSwipe application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Account
You must be at least 18 years old to use the Service.
You are responsible for your account credentials and all activity under your account, including logins through Sign in with Apple. You must provide accurate information, keep it current, and maintain one account per person.
2. What the Service Does
The Service is a roommate-matching platform. You create a personal profile, browse and swipe on other users, and when two users both express interest (a "match"), you can chat in-app to decide whether to live together.
The Service helps you discover potential roommates. It is not a landlord, real-estate broker, property manager, or housing-listing service, and it is not a party to any lease, sublet, payment, or living arrangement you make with another user.
3. No Screening — Your Own Due Diligence
We do not conduct background checks, credit checks, or identity verification on users, and any "verified" indicator is a limited signal, not a guarantee of identity, character, or safety. We do not endorse or vouch for any user.
You are solely responsible for your interactions with other users and for your own safety and due diligence before sharing personal information, meeting in person, exchanging money, or entering any living arrangement. Meet in public first and tell someone you trust.
4. Premium Subscriptions and Billing
The Service offers free use with daily limits (for example, on the number of likes, profile views, or new chats) and optional paid premium subscriptions that raise or remove those limits.
- Payment processor. Subscriptions are sold and billed through Stripe. By subscribing, you also agree to Stripe's terms.
- Recurring, auto-renewing billing. Premium plans are billed in advance on a recurring basis for the interval you choose (for example, weekly or monthly) and renew automatically at the then-current price until you cancel. Each renewal is charged to your payment method on file through Stripe.
- Free trials. If we offer a free trial, your paid subscription begins automatically and your payment method is charged when the trial ends, unless you cancel before then.
- Pricing. Current prices, billing intervals, and any trial length are shown at the point of purchase. We may change prices or plans on a going-forward basis; changes apply to renewals after we give notice as required by law.
- Cancellation. You may cancel at any time through the subscription-management / customer-portal option in the app (powered by Stripe). Cancellation stops future renewals; your premium access continues until the end of the period you have already paid for.
- No refunds. Except where a refund is required by applicable law (including mandatory consumer-protection rights that cannot be waived), all payments are non-refundable, and we do not provide refunds or credits for partial periods, unused time, or features you did not use.
- Taxes. Prices may be exclusive of taxes; you are responsible for any applicable taxes.
- Failed payments. If a charge fails or your subscription lapses, premium features may be suspended and your account may revert to the free tier and its limits.
5. Data We Collect and Store (Data Use Notice)
We collect and store the data needed to operate the Service, including:
- Authentication and security data (Supabase Auth), including account identifier, email, phone, session/authentication metadata, and security logs/tokens.
- Profile and identity details, including name, photos, date of birth and age, gender, pronouns, occupation, employer, education, languages, hometown, and city.
- Roommate-matching attributes and housing preferences/search criteria, including budget, location, move-in timing, lifestyle attributes, and the filters you set for other users.
- Optional sensitive attributes you choose to add (see Section 6), such as sexual orientation/LGBTQ+ details, substance-use habits, and allergies.
- Content and interaction data, including profile prompts, chats and messages, swipe/match decisions, and usage counters.
- Subscription and payment data, including subscription status, plan/interval, renewal and trial dates, Stripe customer/subscription identifiers, and payment history (card details are held by Stripe, not by us).
- Device data with your permission (location and photos) and report/moderation records.
We store this data using Supabase-managed PostgreSQL and object storage infrastructure. For full details on what we collect, how we use it, who we share it with, and your choices, see our Privacy Policy.
6. Sensitive Information and Consent
Some optional profile fields reveal sensitive information (for example, sexual orientation, health/allergy, substance-use, or origin details). Providing them is voluntary, but the matching algorithm relies on them and they are shown to other users. By choosing to add these details, you explicitly consent to our processing and displaying them for matching. If you leave them blank, you may not be matched with or shown to other users. You can withdraw consent by editing or clearing those fields or deleting your account.
7. How We Use Data
- Provide core app functionality (accounts, profiles, swiping/matching, chat, and subscriptions).
- Process payments and manage subscriptions, trials, and usage limits.
- Maintain security, prevent abuse/fraud, review reports, and enforce these Terms.
- Operate, troubleshoot, and improve the Service.
- Comply with legal obligations and respond to lawful requests.
We do not sell or share personal data with third-party advertisers for cross-context behavioral advertising.
8. Third-Party Services
The Service relies on third-party providers, including Supabase (authentication, database, storage, edge functions), Stripe (payments and subscriptions), Google Maps Platform (maps, place search, and geocoding), Resend (transactional/feedback email), and Apple (Sign in with Apple). Your use of features powered by these providers may be subject to their terms, and their outages, changes, or limitations may affect the Service.
9. Legal Bases and International Privacy Frameworks
Depending on your location, we rely on legal bases such as contract performance, consent (including explicit consent for sensitive data), legitimate interests, and legal obligation.
We aim to operate in a manner compatible with major privacy frameworks, including (as applicable) PIPEDA (Canada), GDPR/UK GDPR, and U.S. state privacy laws (such as CCPA/CPRA concepts), but local rights and obligations may vary by jurisdiction.
10. Cross-Border Processing
Your data may be processed in countries other than your own (including the United States). Where required, we use reasonable safeguards for international transfers (for example, contractual and organizational controls) consistent with applicable law.
11. Your Privacy Rights and Account Deletion
Subject to local law, you may request access, correction, deletion, portability, or restriction/objection regarding your personal data. You can edit your profile or delete your account directly in the app; you may also contact service@roommatesplus.ca.
Deletion is performed on a best-effort basis within a commercially reasonable timeframe, taking into account backups, technical constraints, and legal/financial record-keeping obligations. We may need to verify your identity before acting on requests.
12. Acceptable Use and Conduct
You must not:
- Violate laws or the rights of others.
- Be under 18, create an account for someone else, or impersonate or misrepresent who you are.
- Harass, threaten, defame, or unlawfully discriminate against other users, or post abusive, hateful, sexually exploitative, infringing, or otherwise objectionable content.
- Post false, fraudulent, or misleading profile information, or use the Service for scams, solicitation, advertising, or spam.
- Collect, scrape, or store other users' information, or contact them for purposes unrelated to finding a roommate.
- Attempt unauthorized access, reverse engineering, or disruption of the Service.
We may remove content and suspend or terminate accounts that violate these Terms or that we reasonably believe create risk to other users.
13. Safety and Reporting
You can report or block other users in the app. We may review reports and take action, but we are not obligated to monitor conduct and do not guarantee any user's behavior. If you feel you are in danger, contact local emergency services.
14. User Content and License
You retain rights in content you submit (such as photos, prompts, and messages), but grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content solely to operate and improve the Service.
You represent that you have rights to submit the content and that it does not violate law or third-party rights.
15. Intellectual Property and Non-Derivative Use
All rights, title, and interest in and to the Service—including but not limited to its software, design, user interface, features, functionality, databases, text, graphics, logos, and underlying technology—are and remain the exclusive property of the service provider and its partners.
You must not, and must not permit others to:
- Copy, reproduce, distribute, or publicly display any part of the Service except as expressly permitted.
- Modify, adapt, translate, or create derivative works based on the Service or any part of it.
- Reverse engineer, decompile, disassemble, or attempt to extract source code or underlying ideas, algorithms, or structure of the Service.
- Use the Service or its outputs to develop, train, or improve any competing product or service.
- Replicate or build a substantially similar product, service, or feature set based on the Service.
Any unauthorized use of the Service or its intellectual property is strictly prohibited and may result in termination of access and legal action.
16. Disclaimers
The Service is provided on an "as is" and "as available" basis, to the maximum extent permitted by law. We do not guarantee uninterrupted, error-free, or fully secure operation; that you will find a roommate or a match; or the identity, conduct, suitability, or safety of any user. Roommate decisions and living arrangements are made at your own risk.
17. Limitation of Liability
To the maximum extent permitted by law, the service provider and its partners are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunity, arising from or related to the Service, including any interaction with or conduct of another user.
To the maximum extent permitted by law, total aggregate liability for claims related to the Service will not exceed the greater of the amounts you paid to us for the Service in the 12 months before the event giving rise to liability.
Nothing in these Terms limits liability that cannot be limited under applicable law.
18. Indemnity
You agree to defend, indemnify, and hold harmless the service provider and its partners from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, your interactions with other users, or your violation of these Terms or law.
19. Suspension and Termination
We may suspend or terminate access for violations, risk, legal reasons, or service changes. You may stop using the Service and delete your account at any time.
If we terminate your account for breach of these Terms, you are not entitled to any refund of prepaid subscription fees, except where required by law.
20. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when posted (or as otherwise required by law). Continued use after updates constitutes acceptance.
21. Governing Law and Disputes
These Terms are governed by the laws of Nova Scotia, Canada, excluding conflict-of-law rules.
You and we agree that courts located in Nova Scotia, Canada have exclusive jurisdiction over disputes arising from or related to these Terms or the Service, subject to mandatory consumer-law rights in your place of residence where such rights cannot be waived.
